1. Acceptance of Terms

Welcome to Kuhela.ai (the "Site" or "Services"). By using or visiting Kuhela.ai, our browser extensions, our Model Context Protocol (MCP) server, or any other services offered by Kuhela (collectively, "Kuhela", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

2. Privacy-First Service Description

Kuhela provides an AI-powered shopping research assistant designed to work exclusively for you, the consumer. We search, analyze, and rank products in real time without sponsored placement bias. We do not track your searches across the web, nor do we sell your data. Our service is built to return neutral, relevance-based results to help you make informed purchase choices.

3. Eligibility & Acceptable Use

You must be at least 13 years old to use the Services. You agree to use the Services only for lawful personal shopping purposes or as authorized for development of AI applications (via our MCP tools). You must not:

• Attempt to scrape, crawl, or download our product index at scale without prior written consent.
• Interfere with or disrupt the operation of our servers, networks, or API interfaces.
• Attempt to bypass rate limits, authentication measures, or security mechanisms.
• Submit fraudulent, automated, or malicious queries designed to degrade service performance.

4. No Manipulation or Bias

We do not sell sponsored rankings, advertisements, or promoted listings. Any attempt by merchant platforms, sellers, or third parties to manipulate our product discovery algorithms, submit fake reviews, or artificially alter product data within our index is strictly prohibited and will result in permanent blacklisting from our index.

5. Third-Party Retailers & Transactions

Kuhela does not sell, distribute, or ship products directly. We identify and compare purchasing options hosted on third-party retailer websites (such as Amazon, Best Buy, and others). When you click a product link to make a purchase, you are transacting directly with that third-party retailer under their own terms and privacy policies. We are not responsible or liable for order fulfillment, shipping, product quality, safety, legality, or any disputes arising from your transactions with third-party retailers.

6. Waitlist & Early Access

By signing up for our early-access waitlist, you agree that we may contact you regarding your placement in line and key service availability updates. We will never sell your email address to third parties or send you promotional emails unrelated to Kuhela's launch and core features. You can request deletion of your email address from our queue at any time.

7. Disclaimer of Warranties

Kuhela is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. While we strive to present accurate, real-time pricing and availability data, product catalogs change rapidly, and we do not guarantee the completeness or accuracy of third-party store listings, specifications, or pricing shown on our Site.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Kuhela, its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Services.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in San Francisco, California.

10. Changes to Terms

We reserve the right to modify or replace these Terms of Service at any time. We will update the "Last updated" date at the top of this page to reflect changes. Your continued use of the Services after any modifications are published constitutes acceptance of the new Terms.
