Terms of Service

1. Acceptance of Terms

Welcome to Kuhela AI ("Kuhela", "we", "us", or "our"). We build a portfolio of software for photographers: Sky Sync, Shortlist Studio, Shutter Sync, and SnapShare (collectively, the "Services"). By creating an account, installing an app, or otherwise using any of the Services, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Services. Individual products may also present their own in-product terms for features specific to that product; where those terms conflict with this page, the product-specific terms govern for that product.

2. Our Products

Kuhela operates four independent photography tools, each with its own account system and its own subscription. They do not share your account, photos, or data with one another.

• Sky Sync (skysync.kuhela.ai): shoot-condition forecasting for landscape, night-sky, and outdoor photographers.
• Shortlist Studio (shortliststudio.kuhela.ai): a macOS app that culls a shoot and critiques your shots and edits.
• Shutter Sync (shuttersync.kuhela.ai): an agentic social media assistant that curates, captions, and, with your approval, publishes your photography to Instagram and Facebook.
• SnapShare (snap-share.app): collaborative photo and video albums for weddings, events, and group trips.

3. Eligibility & Acceptable Use

You must be at least 13 years old to use any Service (Sky Sync is intended for photographers 16 and older). You agree to use the Services only for lawful purposes, and you must not:

• Attempt to scrape, crawl, or bulk-download data or media from the Services without our prior written consent.
• Interfere with or disrupt our servers, networks, or APIs, or attempt to bypass rate limits or security controls.
• Upload content that is illegal, infringing, harassing, or that depicts the sexual exploitation of a minor in any form.
• Submit automated or fraudulent requests intended to degrade service performance or abuse free trials.

4. Your Content

You retain full ownership and copyright of every photo, video, and caption you upload or connect through the Services. You grant Kuhela a limited, non-exclusive license to host, process, and display that content solely to operate the specific product you're using: for example, generating a culling suggestion, forecasting a shoot, publishing an approved social post, or hosting a shared album for the people you invite. We do not license your content to third parties, and we do not use it to train public AI models (see "AI features" below). If you use SnapShare to create a shared album, you're responsible for having the necessary permission from anyone you photograph or invite to contribute.

5. AI Features

Several Services use AI to assist you: Shortlist Studio's culling and critique, Sky Sync's shoot-readiness scoring, and Shutter Sync's caption drafts, among others. These are assistive tools, not a replacement for your judgment. Shutter Sync in particular requires your explicit review and approval before anything is published to your social accounts, and you remain solely responsible for what you approve. Sky Sync's forecasts are for planning purposes only and are not a substitute for official weather or safety warnings.

6. Subscriptions & Billing

Paid tiers are billed through Stripe, either on a recurring monthly or annual basis or as a one-time fee, depending on the product. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and your account typically reverts to that product's free tier rather than being deleted. Because you receive instant access to computation, storage, and AI processing, subscription fees are non-refundable except where required by applicable law.

7. Third-Party Dependencies

The Services rely on third-party platforms to operate, including Stripe (payments), Google Cloud (hosting, AI, and storage), SmugMug and Meta (Shutter Sync's catalog sync and publishing), and mapping providers (Sky Sync's location search). We are not responsible for outages, restrictions, or changes made by these third parties that affect the Services.

8. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind. Shoot-condition forecasts, AI critiques, and culling suggestions are generated from imperfect models and data, and we do not guarantee their accuracy. Outdoor conditions are inherently unpredictable; use your own judgment and consult official sources before making decisions that affect your safety.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Kuhela, its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, resulting from your access to or use of (or inability to access or use) the Services.

10. Governing Law & Changes to Terms

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any legal action arising under these Terms will be brought in the state or federal courts located in Boulder County, Colorado. We reserve the right to modify these Terms at any time; we'll update the "Last updated" date at the top of this page when we do. Your continued use of the Services after a change is published constitutes acceptance of the new Terms.
